Hit & Run Accidents

Hit & Run Accident Lawyer in Quincy

Inside Knowledge of Insurance Tactics. Direct Attorney Access. No Fee Unless We Win.

When a driver flees the scene, you’re left dealing with injuries, vehicle damage, and a claims process that works differently than a standard car accident. At Powers & Caccavale, we represent hit-and-run accident victims in Quincy and throughout the South Shore. Our team brings over 35 years of combined experience handling personal injury claims in Massachusetts, and we’ve built our practice around one principle: clients shouldn’t shoulder the burden of someone else’s wrongdoing.

We handle these cases on a contingency fee basis, advancing all costs associated with your claim. You owe us nothing unless we recover money on your behalf. Free consultations are available.

If you’ve been injured by a driver who left the scene, call us today at (617) 379-0016. The sooner we get involved, the better positioned we may be to protect your rights and preserve available evidence.

What Qualifies as a Hit-and-Run in Massachusetts

Massachusetts law requires every driver involved in a collision to stop at the scene, exchange identifying information, and render reasonable assistance. This duty applies regardless of who caused the accident. When a driver strikes another vehicle, a pedestrian, or a cyclist and leaves without stopping, that’s a hit-and-run. Under M.G.L. ch. 90 § 24, failing to stop after an accident involving injury or death is a serious criminal offense.

For injured victims, the driver’s absence creates a legal problem as much as a practical one. Standard liability claims require an identifiable at-fault party. Hit-and-run cases rely on a different set of legal tools, and the clock on preserving your rights starts immediately.

Steps to Take After a Hit-and-Run Accident in Quincy

What you do in the hours and days after the accident can significantly affect your claim. Here’s what matters most:

  • Call 911 immediately. Quincy Police Department handles accidents within the city; Massachusetts State Police respond to incidents on I-93, Route 3, and other state roads. Get an official report on file.
  • Capture every detail you can. Note the fleeing vehicle’s license plate, make, model, and color. Look for surveillance cameras on nearby businesses or traffic infrastructure.
  • Seek medical attention promptly. Whiplash, concussion, and soft-tissue injuries often don’t produce symptoms for hours or days. A medical record from the day of the accident can support your claim.
  • Don’t repair or move your vehicle. Paint transfer and physical damage to your car can serve as key evidence. Preserve it until an attorney or insurer has inspected it.
  • Contact an attorney before giving a formal statement to your insurer. Your own insurance company will be involved in any UM claim, and what you say early can affect your recovery.

One procedural step stands apart from the rest. Under M.G.L. ch. 260 § 4B, hit-and-run victims must provide written notice of the time, place, and facts of the accident to both the police and the Registrar of Motor Vehicles within 30 days of the incident. This isn’t a deadline to file a lawsuit. It’s a notice requirement that preserves your right to pursue the driver if they’re identified later. Missing this deadline may affect that right.

How Hit-and-Run Victims Pursue Compensation in Massachusetts

Massachusetts is a no-fault insurance state. Your own personal injury protection (PIP) coverage pays the first $8,000 in medical expenses and a portion of lost wages regardless of who caused the accident. PIP is the starting point for most victims.

When the driver who caused the accident can’t be identified or is uninsured, Massachusetts law allows you to file a claim under your own uninsured motorist (UM) coverage, treating the hit-and-run driver as an uninsured motorist for this purpose. UM coverage can apply to drivers, passengers, and pedestrians struck by a fleeing vehicle. As of July 1, 2025, required minimums for bodily injury liability in Massachusetts are $25,000 per person and $50,000 per accident, though your own policy limits govern what’s available under your UM coverage.

To pursue damages beyond PIP, including pain and suffering, your injury must meet Massachusetts’ serious injury threshold: medical bills exceeding $2,000, a fracture, permanent disfigurement, loss of a body part, or substantial loss of sight or hearing. Recoverable damages may include past and future medical expenses, lost wages, and pain and suffering. If the driver is later identified and carries inadequate coverage, optional underinsured motorist (UIM) coverage can bridge the gap.

Why Quincy Hit-and-Run Victims Choose Powers & Caccavale

Partner Gerard Powers spent over a decade working inside the insurance industry before joining the firm. He knows how claims adjusters evaluate UM cases, which arguments they use to reduce settlements, and what documentation it takes to push back effectively. That background informs how we build and present every hit-and-run claim we take on.
