Workers’ Compensation in Fall River
Direct Attorney Support for Injured Workers
We represent Fall River employees in injury claims, denied claims, and appeals. At Powers & Caccavale, clients work directly with an attorney throughout the workers’ compensation process instead of navigating insurance and administrative requirements alone.
For over 35 years, we’ve helped injured workers and other individuals pursue compensation throughout Massachusetts. One of our partners spent more than a decade working for an insurance company, giving us firsthand insight into how insurers investigate, evaluate, and dispute claims.

Eligibility for Massachusetts Workers’ Compensation Benefits
Massachusetts workers’ compensation is a no-fault system. An employee generally doesn’t need to prove that an employer caused an accident to pursue benefits, but the injury or illness must be connected to the person’s work. Most Massachusetts businesses with employees must carry workers’ compensation insurance, subject to limited exceptions.
Our firm states that an injury must extend beyond five calendar days to qualify for benefits, though those days don’t need to be consecutive. Claims may address necessary medical treatment, lost wages, and disability status. Available support depends on the employee’s medical condition, earnings, work capacity, and other claim-specific facts.
A surviving spouse of a worker killed on the job may receive weekly death benefits equal to 66% of the worker’s average weekly wage, subject to the state average weekly wage cap in effect at the time of death.
The Workers’ Compensation Claim Process
We guide clients through each stage of a Massachusetts claim: reporting the injury, obtaining medical treatment, filing with the Department of Industrial Accidents, and responding to the insurer’s investigation and evaluation. We handle claims arising from sudden accidents as well as occupational diseases caused by working conditions or repeated exposure.
Important information to document includes:
- How and when the injury occurred
- The job duties or working conditions connected to the injury
- The medical providers, diagnoses, treatment, and work restrictions involved
- The dates of missed work or reduced duties
For injuries occurring on or after January 1, 1986, Massachusetts law generally requires a claim to be filed with the insurer within four years after the worker becomes aware of the connection between the injury or illness and employment. A claim involving a work-related death generally must be filed within four years of the date of death. Because notice and filing requirements depend on the facts, workers shouldn’t delay reporting an injury or seeking advice.
Our workers’ compensation practice covers repetitive strain injuries, machine malfunctions, construction accidents, falls, and other work-related injuries. We examine the medical evidence, employment information, and insurer’s position while communicating directly with the client.
Denied Claims & Workers’ Compensation Appeals in Fall River
An insurer’s denial doesn’t necessarily end a claim. We represent workers in disputed claims and appeals, and we’re prepared to take a case to trial when necessary. Fall River has a regional office of the Massachusetts Department of Industrial Accidents, the state agency that administers the dispute process.
A disputed claim may proceed through conciliation, an initial meeting to identify the issues and explore resolution. The next stage may be a conference before an administrative judge. If the dispute continues, it can advance to a formal evidentiary hearing where the parties present testimony and other evidence.
An agency decision may be appealed to the Reviewing Board and then to the Massachusetts Appeals Court. The appropriate response to a denial depends on the stated reason, the procedural stage, and the available medical and employment records. We evaluate those factors and explain the next step directly to the worker.
Work Injuries Across Fall River Industries
Manufacturing, healthcare, and education are among Fall River’s largest industries. Employees in these fields may face different evidentiary questions involving physical duties, repetitive tasks, working conditions, and medical restrictions. Construction, warehouse, transportation, and other physically demanding work can raise similar issues.
We handle claims involving:
- Back, neck, spinal cord, shoulder, and knee injuries
- Foot, ankle, eye, hearing-loss, and burn injuries
- Repetitive strain injuries and occupational diseases
- Construction accidents and machine malfunctions
- Scaffolding, ladder, trip, and slip and fall injuries
- Work-related vehicle accidents
Claims Involving Uninsured Employers
A lack of employer coverage doesn’t automatically leave an injured worker without a potential claim. Workers whose employers lack required insurance can pursue benefits through the Workers’ Compensation Trust Fund. The agency’s Office of Investigations may also issue a stop-work order against an uninsured employer.
These matters can involve questions about employment status, available coverage, and the evidence connecting an injury to the job. We assess the circumstances and manage the workers’ compensation process so the client can focus on medical care.
